These Terms and Conditions (“Terms”) govern your access to and use of the Hongu website, mobile application, content, services, and related features (collectively, the “Services”) operated by Wavemaker Ventures, S.C. (“Hongu,” “Company,” “we,” “us,” or “our”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

1Eligibility

You must be at least 18 years old to use the Services. By using Hongu, you represent and warrant that you are legally capable of entering into a binding agreement.

2Wellness and Educational Purpose

Hongu is a wellness, educational, and lifestyle optimization platform. The Services are intended solely to provide informational content related to health, longevity, fitness, sleep, nutrition, supplementation, habits, biomarkers, and general wellness.

Hongu does not provide medical services, medical diagnoses, treatment, or clinical care.

3No Physician–Patient Relationship

Your use of the Services does not create a physician-patient, therapist-patient, or other healthcare provider relationship between you and Hongu, Wavemaker Ventures, S.C., or any of its employees, contractors, advisors, or affiliates.

4User Responsibility

You acknowledge and agree that:

• Any actions you take based on information provided by Hongu are taken at your own risk;
• You are solely responsible for your health decisions and lifestyle choices;
• You should consult a licensed healthcare professional before making medical, nutritional, supplementation, exercise, or treatment decisions.

5AI-Generated Insights

Certain features may use artificial intelligence, algorithms, wearable integrations, questionnaires, or biomarker interpretation systems to generate personalized insights or recommendations.

These outputs are probabilistic, informational, and non-medical in nature and may be inaccurate, incomplete, or inappropriate for your specific circumstances.

You should not rely on AI-generated outputs as a substitute for professional medical judgment.

6Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

7Intellectual Property

All content, branding, software, graphics, text, protocols, designs, trademarks, and materials provided through the Services are owned by or licensed to Wavemaker Ventures, S.C. and are protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or commercially exploit any portion of the Services without prior written consent.

8Subscription and Payments

If applicable, certain features may require paid subscriptions.

By purchasing a subscription, you authorize recurring billing unless canceled prior to the renewal date.

All fees are non-refundable except where required by law.

9Third-Party Services

Hongu may integrate with third-party platforms, wearable devices, laboratories, payment processors, or external services.

We are not responsible for the availability, accuracy, or practices of third-party providers.

10Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, AND NON-INFRINGEMENT.

We do not guarantee that the Services will be uninterrupted, error-free, or suitable for your needs.

11Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAVEMAKER VENTURES, S.C. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO HONGU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12Indemnification

You agree to indemnify and hold harmless Wavemaker Ventures, S.C. from any claims, liabilities, damages, losses, or expenses arising from your misuse of the Services or violation of these Terms.

13Governing Law

These Terms shall be governed by and construed in accordance with the laws of Mexico, without regard to conflict of law principles.

Any disputes arising under these Terms shall be resolved in the competent courts of Mexico City, Mexico.

14Changes to Terms

We may update these Terms at any time. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

Los presentes Términos y Condiciones regulan el acceso y uso de la plataforma Hongu, incluyendo su sitio web, aplicación móvil, contenido, funcionalidades y servicios relacionados (los “Servicios”), operados por Wavemaker Ventures, S.C. (“Hongu”, “la Empresa”, “nosotros” o “nuestro”).

Al acceder o utilizar los Servicios, usted acepta quedar obligado por estos Términos y Condiciones.

1Naturaleza Informativa

Hongu es una plataforma de bienestar, educación y optimización de hábitos.

La información proporcionada tiene fines exclusivamente informativos y educativos y no constituye atención médica, diagnóstico clínico, tratamiento médico ni servicios profesionales de salud.

2Responsabilidad del Usuario

El usuario reconoce y acepta que cualquier decisión relacionada con salud, nutrición, suplementación, ejercicio, sueño o estilo de vida tomada con base en la información proporcionada por Hongu será bajo su propia responsabilidad.

3Herramientas Automatizadas e Inteligencia Artificial

Hongu puede utilizar algoritmos, inteligencia artificial, integraciones con wearables y sistemas automatizados para generar recomendaciones o análisis personalizados.

Dichas herramientas tienen carácter exclusivamente informativo y pueden contener errores, omisiones o interpretaciones inexactas.

4Limitación de Responsabilidad

En la máxima medida permitida por la legislación aplicable, Wavemaker Ventures, S.C. no será responsable por daños indirectos, incidentales, especiales o consecuenciales derivados del uso de los Servicios.

5Propiedad Intelectual

Todo el contenido, marcas, diseños, software y materiales de Hongu son propiedad de Wavemaker Ventures, S.C. o de sus licenciantes y están protegidos por la legislación aplicable.

6Legislación Aplicable

Los presentes Términos se regirán conforme a las leyes de los Estados Unidos Mexicanos.

Cualquier controversia será sometida a los tribunales competentes de la Ciudad de México.
